Bio of Lisa Martens:

Lisa Martens is a Principal in the San Diego office of Fish & Richardson P.C. Her practice emphasizes trademark prosecution and litigation for the food service, healthcare, biotechnology, computer, Internet, and retail clothing industries. Ms. Martens has significant experience in managing U.S. and foreign trademark portfolios for large international companies. Her internet work includes handling domain name disputes and securing domain names in the U.S. and worldwide, as well as providing advice on legal requirements for conducting online sweepstakes and promotions. Ms. Martens' practice also includes licensing intellectual property and litigation relating to trademarks, copyrights, trade secrets, and false comparative advertising.

Jennifer Kinsbruner Bush is an Associate in the San Diego office of Fish & Richardson P.C. Her practice emphasizes litigation in all areas of intellectual property. Ms. Bush was previously an Associate with Irell & Manella (2001-2002), and a Research Assistant/Summer Associate with Wiggin & Dana. She has other Summer Associate experience with Cleary Gottlieb (1999) and Kirkland & Ellis (1998). Ms. Bush served as a Judicial Clerk to the Honorable Stanley Marcus, United States Court of Appeals for the 11th Circuit (2000-2001).

One of her recent cases was recognized by the National Law Journal as one of the "Top Defense Wins for 2004" (Arendi v. Microsoft).

Bio of David Kleinsmith:

David Kleinsmith is Of Counsel in Fish & Richardson's San Diego office, where he is a member of the Corporate and Securities group. His practice emphasizes complex technology licensing transactions, intellectual property (IP) due diligence, and patent prosecution across a wide range of technologies.

Mr. Kleinsmith has over ten years experience in complex technology licensing transactions, patent preparation and prosecution, IP due diligence in connection with private and public financings, as well as mergers and acquisitions, and corporate work. His representative complex technology licensing transactions include:

Negotiated and drafted a number of complex technology licensing agreement sets, each set directed to forming and/or financing a viable business around IP-protected technology in the pharmaceutical, biotechnology, medical device and/or nanotechnology areas.

Counseled many start-up companies in the strategic protection and/or commercialization of their IP-protectable ideas.

Counseled and assisted businesses in the structuring of their rights under early-priority-date patent portfolios for emerging technologies to provide exclusivity in each business’ core operating field while enabling significant ROI opportunities via licensing outside the core operating field.
In addition, Mr. Kleinsmith has prepared over 44 patent applications, and has prosecuted numerous others, for inventions in the following technology areas: pharmaceuticals, biotechnology, medical devices, nanotechnology, chemical, mechanical, fuel cells, and oil discovery tools. Mr. Kleinsmith also has experience in the corporate sector, where he has conducted (for investor/acquirer clients) and managed (for target/acquiree clients) IP due diligence for seven acquisitions, three mergers, six private equity financings, and three public offerings.

His professional experience includes the role of Principal and Founder of Idea.Law, APC (2003-2006), where he handled complex technology licensing transactions, IP due diligence, strategic IP counseling, preparation and prosecution of patent applications, and preparation of patent opinions. He was the Vice President of Intellectual Property and Director of Legal Affairs at NanoGram (aka NeoPhotonics) Corporation (2001-2003). He was also the Vice President of Intellectual Property, and Director of Legal Affairs at Metallic Power, Inc. (2001-2002). Prior to 2001, Mr. Kleinsmith worked as an associate for two large law firms in San Diego, where his practice was servicing the transactional IP needs of a mostly start-up clientele.

Mr. Kleinsmith has technical experience from Research Assistant roles at Lawrence Berkeley Laboratory in the Cholesterol Research Center (1989-1990), and in the Chemical Biodynamics Division (1985, 1988-1989).
